I ran this situation (as I understand it) by a lawyer I know.
His suggestion to anybody who fears that their Emails to this list may appear
in a book is:
Print out the posts in question.
Call the U.S. Copyright Office in Washington D.C. and ask them to send you
the "Copyright" form -- I believe this is Form TX. (The form is free).
Fill out the form (it's a one page form & not that difficult to fill
out)(Under "Title of This Work" you might for instance fill in "My posts to
the Pynchon list dated *****").
Attach copies of the relevant posts & mail them + the form in along with the
filing fee (I believe it is $20).(I believe you can use one form to copyright
all of your Pynchon posts.)
They will mail you back a Certificate of Registration.
Mail a copy of the Certificate to any person and/or publisher who you feel
may be thinking of publishing your work, informing them that you hold the
copyright and that they cannot print it.
If they wilfully print it after being so notified, they may be liable for
statutory damages of up to $l00,000.
