Jimmy,

Thanks for reminding me about Denver Area.  I'll have to go back and reread
that opinion.  Actually, my original argument that Pynchon listers have
little to worry about was based more on political considerations than legal
ones.  Even assuming that the Supreme Court is so backward as to approve the
CDA, or some form of it, as constitutional, I simply cannot imagine a
prosecutor finding it worth his or her time to go after a list whose entire
purpose is to discuss the works of Thomas Pynchon.  I don't think society has
slipped that far yet.  In particular, I'm thinking of the shitstorm of
censure that arose, even from Republican family values stalwarts, when the
Congressman from Oklahoma foolishly chastised NBC for broadcasting the nudity
in Schindler's List during the so-called family hour.  [NO, NO, this is NOT
an invitation to start up the Schindler's List list again!]  There is so much
true porn on the internet that I just can't imagine anyone bothering to go
after the Pynchon list.  Maybe I'm naive.

In any event, I'm encouraged by Justice O'Connor's questions about whether
the internet is like a town square, which has always had the utmost First
Amendment protection.  Don't write off the Supreme Court yet.
