It's an interesting test case. I assume that UPS will be pursuing the suit
in a Canadian civil court, in which case it will be up to that legislative
body to decide the verdict. The court, I guess, will be bound by the terms
of the global trade agreement that the Canadian government has signed. If,
at that time, the rules of that particular treaty had been endorsed by the
Canadian government, which is the democratically-elected national authority
and constitutional guarantor, then this would effectively equal domestic
legislation to the effect that Canada Post should conform to whatever the
new trade practices are.
I'm not sure that it's all that far afield of global policies which mandate
industrial carbon emission levels or quotas for fisheries. Sometimes a
global approach is a good thing.
