Am I wrong, or ...

... or was this essentially a case of a couple of guys
writing fiction but claiming it as fact suing a guy
who seemingly took it as fact and wrote a work of
fiction as if it was?   As in the case of McEwan,
isn't this, from the novelist's point of view, at
least, a matter of research, than of plagiarism? 
Didn't Baigent and Leigh's suit imply that it was not
their research that was lifted, but rather their
invention?  Doen't this imply that they made it all
up?  What next, then, say, Richard Sasuly suing Thomas
Pynchon over the appropriation of I.G. Farben by
Gravity's Rainbow?  Sheesh!
