that is what they call "obiter dictum", right?

Judge very kindly points out that such extraordinary efforts in
defense of cargo probably won't continue if not rewarded...
these cheap bastards don't deserve the steadfast delivery efforts of
the "captain and the fearless crew", but the Skipper failed
to get any reward clause in writing so it's not incumbent upon the
court to enforce generosity
