The Feds don't have the legal authority to make NCLB compulsory. If a state turned down the money, they would not have to comply.
 
10% of school budgets is a *lot* of money, though, and, especially in today's economy, turning it down would be a tough sell to local parents and tax payers. (By the way, that "10%" figure varies greatly from state to state.)
