Another lawyer here, and one who is about a week behind on reading the
Pynchon list. In general, I concur with the good Doktor's comments.
The obscenity part of the Communications Decency Act is currently before the
Supreme Court and is being argued either this week or next.
The indecency and "intent to annoy" parts of the CDA are currently the
subject of a constitutional challenge in a federal district court in San
Francisco. An opinion is expected in late spring or early summer and will be
appealed directly to the Supreme Court, bypassing the Court of Appeals.
The likelihood of anyone being prosecuted for spreading the Pynchon gospel is
minuscule, it being the ultimate in "redeeming social value." They'll go
after the porn, the gay, and the political first.
